Updated Accessory Dwelling Unit Ordinance Passed by the City Council

Thank you to the 89 Newton for Everyone supporters who sent in letters of support for the additional amendments to the ADU ordinance along with updating Newton’s ADU ordinance to align with state law. The additional amendments allow larger ADUs that will make them more family friendly and allow the space needed to ensure accessibility. Public testimony overwhelmingly supported the amendments.

The City Council voted unanimously to approve the version of the ADU ordinance that complies with state law.

The City Council voted 18 to 6 to approve the additional amendments. Councilors Baker, Farrell, Gentile, Lucas, Oliver and Malakie opposed.

ADU ordinance Amendments needed for consistency with the state law:

  • Allow 900 sf ADUs by right.

  • Eliminate owner occupancy requirements

  • Eliminate occupancy limits that are less than building code limits. (Newton now requires no more than four unrelated adults on a property)

  • Eliminate design standards not required for the primary dwelling

  • Establish setback requirements no less than those required for the primary dwelling or accessory buildings.

ADU Amendments to improve the ordinance:

  • Increase to 1,200 sf the by-right size of an internal ADU in homes built more than 4 years ago.

  • Increase to 1,200 sf the by-right size of the external ADU in homes built more than 4 years ago and allow up to 1,000 sf in newer homes. Allow up to 1,500 sf  by Special Permit.

  • Allow by-right existing historically significant buildings to be adapted to the full extent of the existing floor area, including those within historic districts.
